Why are data rights important?

The government changed course on its attempt to seize smart meter data after ORG raised concerns.

But our ability to challenge data abuses in the future is under threat with the #DataGrabBill, as the government will be able to compel the disclosure of data that can be shared between agencies.

With weaker rights to access our data, secretive profiling will be supercharged.

NHS England is facing a judicial review over the contract for the Federated Data Platform that was recently awarded to #Palantir.

Foxglove, the Doctors’ Association UK, National Pensioners’ Convention and Just Treatment argue the #NHS has no legal basis for setting up the Platform.

The #DataGrabBill provides a legitimate interest to share data for improving services or profiling, effectively legalising the sale of personal data to third parties.

It weakens the data rights that were use to challenge Grindr when it collected and shared user's information with advertisers. This included location, sexual orientation and mental health, putting user's at risk of unwanted outings.

The #DataGrabBill will make it harder to fight heavy-handed surveillance being used on migrants and refugees.

The Bill introduces a legal ground for public and private bodies to share information for national security and public safety, including immigration enforcement or border security.

It paves the way for intrusive #surveillance with information from data brokers, credit history, employment and housing.

Полномочия министров по расширению списка «законных видов использования» включают в себя сообщение о преступных действиях или информирование соответствующих органов о предполагаемых преступлениях или подозрениях в совершении преступлений.

Refugees, who may have endured years of waiting without the right to work or access to funds, often rely on benefits to start a new life.

Continuous scrutiny of their bank accounts poses discriminatory risks, potentially triggering red flags without valid reason.

For example, red flags in the context of transferring money overseas will disproportionately affect migrants and refugees sending money to family abroad.

Risks are distributed unequally.

That’s why #GDPR requires organisations to have a framework to identify and mitigate harms to communities that are at high risk.

The #DataGrabBill removes the requirement for organisations to consult with individuals or groups who are affected by high risk processing, and the requirement to have an independent data protection officer.

This puts people and organisations themselves at risk of costly errors.
