Nervt es euch auch, dass ihr für Netflix, Disney+, Amazon Prime, Paramount+, RTL+ und so viele weitere Streaming-Dienste immer Abos abschließen müsst? Habt ihr euch stattdessen schon mal überlegt, ob es nicht schlauer wäre, Filme einfach zu kaufen?
Aber dann müsstet ihr euch ja auch wieder entscheiden ob ihr den Film bei Amazon Prime, Google oder Apple kauft. Und dann kann es euch immer noch passieren, dass Amazon plötzlich die Rechte an dem Film verliert und ihr diesen, obwohl ihr dafür bezahlt habt, nicht mehr ansehen könnt.
Oder ein anderes Beispiel: Ihr habt ein Buch gekauft und würdet es jetzt gerne als E-Book noch einmal lesen. Was müsstet ihr tun? Richtig: Das Buch erneut als E-Book kaufen. Oder als Hörbuch
Ein weiteres Beispiel wäre, wenn ihr ein Spiel für PC gekauft habt und dieses jetzt aber doch lieber auf der PlayStation spielen möchtet. Wieder gibt es nur eine Lösung: Kauf das Spiel doch einfach ein zweites mal.
Ein Lösungsvorschlag
Wie wäre es, wenn wir „einfach mal“ das Urheberrecht revolutionieren.
Kurze Definition bevor es los gehtWerkEin Werk ist etwas, das mit kreativer Leistung erschaffen wurde.
Also zum Beispiel ein Buch, ein Film, eine Serie, ein Song, ein Videospiel und so weiter.
Plattform
Eine Plattform ist eine Art, wie du ein Werk konsumieren kannst.
Also zum Beispiel ein Streamingdienst für Filme, eine bestimmte Konsole oder ein PC für Videospiele, ein E-Book Reader für Bücher.
Aber auch ein gedrucktes Buch, eine MP3-Datei oder eine DVD / BluRay kann eine Plattform sein.
Die Grundidee
Statt ein Werk für eine bestimmte Plattform zu kaufen, kauft ihr euch eine Nutzungslizenz für das Werk, die ihr auf verschiedenen Plattformen aktivieren könnt.
Diese Nutzungslizenz berechtigt euch, ein bestimmtes Werk zu konsumieren. Und das unabhängig von der Plattform und unbegrenzt lange.
Technisch könnte man das zum Beispiel über ein digitales Zertifikat oder etwas ähnliches lösen.
Mit dieser Nutzungslizenz geht ihr dann zu einer Plattform und sagt: „Ich würde gerne ein Werk, für das ich eine Nutzungslizenz gekauft habe, auf dieser Plattform konsumieren.“
Ein Werk kaufen
Eine Idee wäre es, vorzuschreiben dass immer, wenn ein Werk auf einer Plattform angeboten wird (beispielsweise ein Film kann auf Netflix gestreamt werden), es die Möglichkeit geben muss, eine Nutzungslizenz für dieses Werk zu kaufen.
Wenn wir beim Netflix Beispiel bleiben, gäbe es also einen Button „kaufe eine Nutzungslizenz für den Film Harry Potter und der Stein der Weisen“.
Diese Nutzungslizenz könnte, ähnlich wie die Buchpreisbindung, auf allen Plattformen gleich sein.
In der Praxis wird diese Nutzungslizenz wahrscheinlich teurer sein, als wenn ihr die Werke in einem Abo konsumiert, aber dafür kann sie ja auch auf anderen Plattformen aktiviert werden und gehört euch auf unbegrenzte Zeit.
Ein Werk auf einer andere Plattform aktivieren
Jetzt habt ihr diese Nutzungslizenz und wollt diese nutzen.
Also sucht ihr euch eine Plattform, die ein Werk anbietet. Bei jeder Plattform, die ein Werk zum Konsumieren anbietet, muss auch die Möglichkeit vorhanden sein, eine Nutzungslizenz zu aktivieren.
Die Plattform kann dann eine Gebühr für die Aktivierung verlangen oder ein Abo erfordern. Schließlich entstehen ja auch Kosten für den Betreiber der Plattform.
Wenn wir unser Beispiel von gerade eben nehmen, könntet ihr jetzt also auf Amazon Prime Video gehen, den Film „Harry Potter und der Stein der Weisen“ suchen und diesen aktivieren. Dabei müsst ihr eure Nutzungslizenz vorlegen und bestätigen, dass ihr auch die Person seid, der diese Nutzungslizenz gehört. Und dann könntet ihr den Film über die Amazon Prime Video App ansehen.
Die VorteileKein Vendor Lock-in
Im Moment ist man, wenn man digitale Werke kauft, an eine Plattform gebunden und kann diese nicht einfach wechseln. Das ist vor allem dann problematisch, wenn eine Plattform ihre Nutzungsbedingungen so ändert, dass man diese persönlich nicht akzeptieren möchte. Dann kann man die Werke, für die man ja bezahlt hat, nicht mehr nutzen.
Verlust von Zugriff auf gekaufte Werke
Wenn eine Plattform, auf der Werke gekauft wurden, den Dienst einstellt, verliert man selbst den Zugriff auf die Werke, für die man bezahlt hat und hat keine andere Möglichkeit, als sie auf einer anderen Plattform noch einmal zu bezahlen.
Wechsel der Plattform-Art möglich
Lebensumstände ändern sich. Wenn man früher ein Buch gelesen hat, findet man jetzt im Alltag kaum mehr Zeit dazu und würde es lieber als Hörbuch hören.
Mit einer Nutzungslizenz könnte man einfach eine andere Art, ein Werk zu konsumieren nutzen.
Szenarien für die Umsetzung
Lass uns mal ein paar Szenarien aufmachen, die beschreiben wie das Nutzungslizenz-Konzept in der Praxis funktionieren könnte:
Auf Amazon habt ihr das Buch „Die unendliche Geschichte“ als E-Book bestellt. Amazon hat euch angeboten, gleich eine Nutzungslizenz für einen kleinen Aufpreis mitzuerwerben.
Ihr ladet das Buch auf euren Kindle und ihr beginnt zu lesen. Nach einigen Tagen fällt euch auf, dass ihr gar keine Zeit zum lesen habt und das Buch lieber als Hörbuch hören möchtet.
Ihr geht zu Audible und sucht das Hörbuch dazu. Amazon weiß ja schon, dass ihr eine Nutzungslizenz habt und bietet euch an, diese für das Hörbuch zu aktivieren. Ihr bezahlt nur die Plattform-Gebühr, die geringer ist als der ursprüngliche Kaufpreis der Nutzungslizenz.
Nach einigen Jahren entscheidest du dich für Digital Detoxing auf einer einsamen Insel. Da würdest du gerne „Die unendliche Geschichte“ mitnehmen, aber für einen E-Book-Reader ist auf der Insel kein Strom.
Du gehst in einen Buchladen und suchst dir das Buch heraus. An der Kasse zeigst du deine digitale Nutzungslizenz (zum Beispiel QR-Code). Das Kassenpersonal kann überprüfen dass diese Nutzungslizenz echt ist und dass sie dir gehört. Du zahlst für das Buch nur die Plattform-Gebühr (also die Kosten für Druck und Vertrieb), die geringer ist als die Kosten der Nutzungslizenz.
Mit dem Buch machst du dir eine schöne Zeit auf der einsamen Insel und hast dir Geld gespart.
Beim Streaminganbieter WOW startet die zweite Staffel von „House of the Dragon“. Du weißt schon zu Beginn, dass du diese auf jeden Fall öfters ansehen willst; spätestens vor der dritten Staffel zum auffrischen der Handlung.
Also entscheidest du dich statt für ein Abo von WOW, für den Kauf einer Nutzungslizenz. Klar ist diese teurer als wenn du den Streaming-Dienst für 3 Monate abonnierst, aber da du die Staffel ja öfters ansehen willst ist es für dich insgesamt günstiger. Du bezahlst außerdem zusätzlich die Plattform-Gebühr, da du sie ja jetzt beim Streaminganbieter ansehen möchtest.
Ein oder zwei Jahre später erscheint die dritte Staffel. Unglücklicherweise ist in der Zwischenzeit der Streaminganbieter WOW sein Geschäft in Deutschland eingestellt. Die neue Staffel läuft jetzt bei Amazon Prime Video. Dort gibt es auch die zweite Staffel, von der du jetzt gerne einen Re-Watch starten möchtest.
Du könntest deine Nutzungslizenz jetzt bei Amazon aktivieren, aber du bist mit einigen Dingen in deren AGB nicht einverstanden, weshalb du dort auf keinen Fall einen Account erstellen möchtest.
Stattdessen kaufst du dir in einem deutschen Online-Shop die Blu-Ray der zweiten Staffel. Du lädst deine Nutzungslizenz (die du von Wow beim Kauf per E-Mail zugeschickt bekommen hast) im Warenkorb hoch, bestätigst deine E-Mail-Adresse und zahlst nur noch die Plattform-Gebühr, die geringer ist als die Kosten für die Nutzungslizenz und auch geringer als die Kosten die du für die Blu-Ray so zahlen würdest.
30 Jahre in der Zukunft erinnerst du dich an die geniale Mittelalter-Serie aus den zwanziger Jahren. Blu-Ray Player gibt es in keinem modernen Zukunfts-Haushalt mehr. Stattdessen wurde ein Zukunfts-Dateiformat entwickelt, mit dem man Filme und Serien lokal auf einem Endgerät speichern und abspielen kann, ohne an einen Anbieter gebunden zu sein.
In der internationalen Medien-Bibliothek suchst du nach der Serie, weißt deine Nutzungslizenz nach und lädst die Serie in dem Zukunfts-Dateiformat herunter und kannst sie auch jetzt noch ansehen, ohne wieder den vollen Preis dafür zu bezahlen. Eine Plattform-Gebühr zahlst du dieses mal nicht, da die internationale Medien-Bibliothek von Kulturförderungen in allen Ländern finanziert wird.
Über Jahre hast du in deinem Spotify Account sehr viele Nutzungslizenzen für Musik-Alben gekauft und so eine ordentliche Sammlung aufgebaut.
Leider hat jede große Plattform auch mal ein Ende und Spotify wird, nachdem die Nutzerzahlen über einen langen Zeitraum zurückgegangen sind, nun endgültig eingestellt.
Das macht dir aber nichts aus, denn du warst schlau und hast Nutzungslizenzen gekauft statt eine Flatrate zu abonnieren.
Also kannst du jetzt deine Nutzungslizenzen auf einem neuen Musik-Streaming-Anbieter wieder aktivieren.
Da der neue Musik-Streaming-Anbieter genossenschaftlich organisiert ist, brauchst du hier keine Plattform-Gebühr für die Aktivierung zahlen, da du Mitglied in der Genossenschaft geworden bist, und somit die Plattform-Gebühren aus deinen Mitgliedsbeiträgen finanziert werden.
„Red Dead Redemption II“ hast du dir für deinen Gaming-PC gekauft. Als Nutzungslizenz. Aber irgendetwas stimmt mit der Grafikkarte nicht. Die gibt schön langsam den Geist auf. Eine neue Grafikkarte ist inzwischen so teuer, dass es sich schon fast nicht mehr lohnt eine zu kaufen.
Du entscheidest dich, vom PC-Gamer zum Konsolen-Gamer zu werden und kaufst dir eine PlayStation.
Früher hättest du jetzt alle Spiele erneut kaufen müssen. Dank der Einführung der Nutzungslizenz ist das jetzt einfacher.
Im PlayStation Store aktivierst du einfach deine Nutzungslizenz für „Red Dead Redemption II“. Du bezahlst die Plattform-Gebühr gerne. Schließlich müssen ja die Entwickler, die das Spiel für die Playstation portieren und optimieren, sowie die Server-Kosten, Marketing, Verwaltung und was sonst noch alles dazu gehört, auch bezahlt werden.
Du lädst das Spiel herunter und kannst los spielen.
Und wer weiß: Vielleicht wird deine nächste Konsole ja eine Xbox. Du bist ja nicht mehr an ein bestimmtes System gebunden.
Man könnte noch 1000 weitere Beispiele finden:
- Apps, die man auf iOS gekauft hat auf einem Android-Gerät aktivieren
- Filme die man im Kino gesehen hat auf einem Streaming-Dienst aktivieren
- Bücher aus einem Buchladen auf dem E-Book Reader aktivieren
- usw.
Fazit
Dieses Konzept hätte viele Vorteile für Verbraucher, würde den Wettbewerb und Innovationen der Plattformen fördern und unabhängiger von großen Tech-Konzernen machen.
Durch digitale Zertifikate ist so ein Konzept auch einfach umzusetzen.
So viele Vorteile, dass es sich lohnt, darüber einmal nachzudenken.

Bloody Canadian Media Companies: I subscribe to cable minimally, basically just to get live/local news, some movie channels, and the two national sports channel, TSN (BellMedia) and Sportsnet (Rogers). All in, with a $15 landline, an outdoor security camera, and 1Gbps Fibre Internet, it costs about $230/mo. TSN has 5 live channels. Five! This morning they have two dedicated to the same Formula 1 broadcast and two showing their Sports newscast on repeat.
Meanwhile, on their app, they have TSN+. This used to be included in the main subscription. It shows La Liga football matches, among other things. There are two La Liga matches and one world Rugby match available.
I wanted to watch Valencia v Athletico Madrid today but NO.
