Farewell to Justice Sandra Day O’Connor, who died at 93 from complications of dementia. Though I often disagreed with her positions, there’s no question she blazed a trail as the High Court’s first female justice. Considered a conservative at the time of her appointment in 1981, her positions seem quite moderate today given how far off the deep end “conservatism” has veered since then. Rest in power.

TITLE: OT: "Polite" Codes in Racism?

I'm a 54-year-old White guy in the USA and I have to infer that there must have been -- at one time not too long ago -- racist codes for "let the White person go first". I was never taught them, but I have to infer this from a few decades now of observing the following:

When I am standing in a small family-run store checkout line, and elderly Black people are in front of me, if I have a cough or need to clear my throat, something very strange happens. All eyes swivel backwards to look at me, and the elderly Black people in front of me all but fall over themselves to waive me to the FRONT OF THE LINE. Sometimes if I lock eyes with the shop keeper at the register, HE waives me forwards. At this point, there is NO POLITE GETTING OUT OF IT. I can try saying "I'm so sorry, I have a cold", or "you are clearly in front of me, please proceed", and none of it will work. Instead, I am given excuses to help ME feel better about myself. "Oh, no, I'm in no hurry", or "I have not quite decided if I have everything yet", or "the shopkeeper and I were just talking, we will be awhile, so please checkout first".

To be clear, I'm not the one being hurt (they are), but I AM mortified and embarrassed.

I've had to develop special procedures to combat this. I always stand a little further back in line, NEVER make eye contact with anyone, look intently at merchandise while waiting to checkout, and UNDER NO CIRCUMSTANCES ever clear my throat no matter how much I may need to.

I was reminded of this today when I (with plenty of room) passed an older Black woman in an aisle and merely nodded hello. She said "excuse me" and stepped backwards to give me more space. Huh.

Younger Black people don't do this (happily). Older Black people sometimes seem startled, like they have not encountered a White person coughing behind them in a long time -- but then their automatic training kicks in...

When I think about racism, I usually think about the more egregious examples (lynchings, denial of voting rights) but I have to wonder -- **what was it like to just go on a mundane daily shopping trip in 1960?**

QUESTION: Older folks reading this. Did/does this cough/throat-clear signal actually exist??

Today in Labor History November 4, 1839: The Newport Rising began. It was the last large-scale armed rebellion against authority in mainland Britain. It began when approximately 4,000 Chartists, led by John Frost, marched on the town of Newport. When several were arrested, other Chartists, including coal miners, many armed with homemade weapons, marched on the Westgate Hotel (where they were held) to liberate them. Up to 24 were killed when soldiers were ordered to open fire on them. The Chartists were fighting for the adoption of the People’s Charter, which called for universal suffrage, the secret ballot, and the right of regular working people to serve in the House of Commons. Three leaders of the uprising were sentenced to death, but popular protests got their sentences commuted to Transportation for Life, probably to Australia or Van Dieman’s Land (Tasmania). America’s first cop, Allan Pinkerton, supposedly participated in this rebellion. He was a known Chartist in those days, a physical force man who loved to battle cops and Tory thugs. Because of his history of street violence and vandalism, he had to flee Britain in the dark of the night, ultimately settling in Illinois, where he eventually set up the private detective agency that would go on to murder numerous union organizers, and set up hundreds more for long prison stints through the use of agents provocateur and perjured testimonies.

The riots were depicted in the following novels: “Sir Cosmo Digby,” by James Augustus St John (1843), “Rape of the Fair Country,” by Alexander Cordell (1959) and “Children of Rebecca,” by Vivien Annis Bailey (1995).

UPDATE: Philadelphia police officer Mark Dial WAS out on $500,000 bail. Dial shot Eddie Irizarry through the window of his car on August 14 and lied to the public saying, Irizarry was out of his car and lunging at him with a knife. The district attorney wanted bail revoked saying, it is a direct violation of the Pennsylvania Constitution. Bail is not granted in Pennsylvania for murder cases.

BREAKING NOW: This afternoon, a judge revoked bail and former officer Mark Dial is now behind bars for the murder. It's about time that the two-tiered justice system made such a ruling. It's time for more of this. Keep fighting.

Vivaldi – Setting an Example for Other Instances on Mastodon regarding Ableism:

I don't often have good things to say about many companies, however, in this case I have no choice but to commend the makers of #VivaldiBrowser in regard to their @Vivaldi instance, here on Mastodon.

Many users with disabilities, including myself, have often taken exception to most instance rules and the wording of the "Mastodon Server Covenant". I have had a piece on the back burner about this issue for quite some time, while examples of this problem continued to occur. Many disabled users have said they feel excluded by these rules, and therefore, left vulnerable to ableism. I personally have had certain instance administrators ignore blatant examples of ableism, seemingly on the technicality that, it does not violate their rules; or that of the Mastodon Server Covenant. To be clear, the instances I have accounts on (kolektiva.social and neurodifferent.me) do list ableism as an offense, and neurodifferent.me seems particularly protective of CERTAIN users in this way.

Servers on mastodon are required under the covenant to have:
"Active moderation against racism, sexism, homophobia and transphobia.
Users must have the confidence that they are joining a safe space, free from white supremacy, anti-semitism and transphobia of other platforms."
There is absolutely no mention of ableism or any categorization that it would fall under. So, what about Vivaldi social?

I downloaded the Vivaldi browser last week and have not completely familiarized myself with it but, if you like the bells and whistles that go along with customizable browsers, you should like Vivaldi. It's equipped with many fantastic features for research and writing, as well. They have also recently taken steps to protect the privacy of it's browser users from prying Google eyes. After discovering that they had an instance here on Mastodon, I reached out to Vivaldi who graciously responded to me on several occasions. Their Mastodon instance even offers its users a blog space for writing. This was an exciting prospect for me.

When I looked up instance rules for Vivaldi social, I found the rules to be very similar to many instances and Mastodon's server covenant with a couple of additions including: xenophobia and casteism. Though xenophobia would seem to encompass ableism, I asked about the absence of the term on their server rules. Today, I received a response that speaks volumes about the character of those involved with Vivaldi and their Mastodon instance.

The correspondence said in part: "While for us it's common sense that any form of discrimination is not acceptable, it probably is best to spell it out more clearly. So, we've tweaked the wording of the server rules now." So what do Vivaldi's "tweaked" rules say?

"No discrimination of any form (incl. racism, sexism, homophobia, transphobia, xenophobia, casteism, ableism, etc.)".

I was pleasantly flabbergasted by this. Words like "fantabulous" and "bravissimo" are not a strong enough complement to this statement of equality and inclusion of the disability community by Vivaldi. Thank you so much for this consideration. Hopefully, other servers will follow the example you have set by adding one simple word to your server rules. You are truly a friend and ally to people with invisible disabilities throughout the world. There is no doubt in my mind about another statement on Vivaldi's server registration page: "EVERYONE IS WELCOME". Thank you again Vivaldi.
