well fuck #PaulaDeen ('s legal team) that's stupid as hell.
A hyper-edited video of her saying "now put it in the oven for 350 hours at 3 degrees" does not harm your #copyright (fuck all copyright btw) and is obviously #Fairuse due to being transformative and useless as a replacement of the original work
Just another day on #Youtube
Just Catching Up Dept: So #RickBeato got invited to a bipartisan DC hearing / panel on #AI with Sen Schumer , Sen Rounds , Sen Heinrich and Sen Young et al. The hearing on issues related to #Copyright and #FairUse sets out to address a regulatory framework for dealing with AI related issues, so it's very satisfying that people with direct insight were in attendance. More of this
This new #EFF (@eff) brief has the important goal of striking down the #DMCA #anticircumvention clause in the name of #FairUse and #FreeSpeech.
But the principle that "Pseudo-#IP Rules Shouldn't Block Free Speech" has the nice side effect of highlighting what's wrong with this otherwise unrelated effort:
"Jewish Americans Try to Trademark Pro-Palestinian 'River to the Sea' Slogan"
"Went for a walk along the River Don after a busy day at work and decided to get some shots. Just as I got back to the car and away to go home three baby bunnies were sitting looking at me. I sat down on the kerb and they didn't seem to worried by me if I didn't make them jump. This is right next to one of the busiest roads in Aberdeen, just a metre away." photo and text scott clark
"The riverine rabbit (Bunolagus monticularis), also known as the bushman #rabbit or bushman hare, is a rabbit with an extremely limited distribution area, found only in the central and southern regions of the Karoo Desert of South #Africa's Northern Cape Province. It is the only member of the genus Bunolagus because of unique traits that separate it from the other leporids. It is one of the most #endangered mammals in the world, with only around 500 living adults, and 1500 overall." photo p carter

"I had walked past this #fox street art a number of times and knew there were foxes in the area. I waited it out one evening and after a while, one of the foxes came by. It stopped briefly right by the artwork, appeared to look at it and I managed to get a photo. It then carried on its way. It really felt like a once in a lifetime opportunity!"

"I’ve resigned from my role leading the Audio team at Stability AI, because I don’t agree with the company’s opinion that training generative AI models on copyrighted works is ‘fair use’." — Ed Newton-Rex https://www.musicbusinessworldwide.com/why-just-resigned-from-my-job-generative-ai/ #generativeAI #copyright #fairuse
@panther_modern To be fair, that section seems much more (still not very much, but yet much more) reasonable in the context of the previous parts of the document that argue at length (maybe wrongly, but AFAICT not completely implausibly) that use for model training is #fairUse.
Though if model training was fair use, same should apply for all non-"AI"-created #mashUps, too, I'd think. And morally it'd only be fair if the models trained that way would themselves be made public and freely licensed

Whilst not indigenous to the UK the Black Swan has a tendency to ingratiate itself with it's larger cousins, the Mute Swan. Side by side though they are much smaller in size and utter a musical and far reaching bugle-like sound which is very different to the Mute Swan." (photo and text N Hurst)
@malwaretech I'm just glad machine-made works can't be copyrighted.
Which in turn means a machine can't create stuff nor violate copyright.
And yes, I do think that the #Copyrightmafia is rather working on making macine-made content copyrightable is bad.
Also no, I never lived in a juristiction that has #FairUse nor was Fair Use in any way or form enforceable...
This is canonical #FairUse, the kind of copying that almost always involves overriding the objections of the site's proprietor. Not all adversarial scraping is good, but this sure is.
There's an argument that scraping the news-sites without permission might piss them off, but it doesn't bring them any real harm. But even when scraping harms the scrapee, it is sometimes legitimate - and necessary.
"‘Floral Bath Tub’ by Mousam Ray
A crimson sunbird is seen enjoying cooling water pooled in the petal of a banana flower in India. Ray’s images often pick birds as their subject, and in this instance he notes the sunbird is “showing a very rare behaviour”. It’s “as if nature creates a floral bath tub for her”, he says."

Update. Trade orgs for very profitable US #entertainment companies, thriving under US #copyright law, are #lobbying #SouthAfrica not to adopt US-style #FairUse. The Library Copyright Alliance (#LCA) is calling them out.
The same US copyright orgs "argue that academic freedom would be threatened if scientists have the right to freely share the results of Government-funded research."
TLDR: If a tech standard becomes part of a legal standard, you can share it freely online without fear of liability for infringement.
“Many private organizations develop and copyright suggested technical standards ... We hold that the non-commercial dissemination of such standards, as incorporated by reference into law, constitutes fair use and thus cannot support liability for copyright infringement.

On the left, my original photograph of an acrobat ant. On the right, an image that Orkin just put on their website to illustrate an acrobat ant.
They did not get my permission to use this image. I do not think moving one antenna and flipping the image is transformative enough to consider this fair use.
Yesterday was a BIG day for IP & Internet Law at #SCOTUS.
We got decisions in:
Have you been watching Warhol v. Goldsmith? We think #FairUse might still be OK after the US Supreme Court ruled on this closely watched case. While it’s hard to predict the full ramifications of this decision now, our initial opinion is that it's not ideal, but also not the death knell for transformative fair use that many feared it could have been. https://loom.ly/EZTh8LY

But what about #FairDealing (similar to #FairUse)? Linkletter argued that linking to a video that shows that Proctorio's assurances to parents and students about its products' benign nature were contradicted by the way it talked to educators was fair dealing. Fair dealing is a broad suite of limitations and exceptions to copyright for the purposes of commentary, criticism, study, satire, etc.
