As Moran points out, this exemption would cover - among other institutions - the far-right #FederalistSociety, which satisfies all those criteria. That means a Supreme Court justice could sit on the board and raise funds for the #FedSoc without raising any issues with this code - not even one of those squishy "shoulds."

During the event, the group announced a new initiative focused on getting #conservatives on the #SupremeCourt & the #FederalBench. They appointed a fmr employee of #GinniThomas, Justice #ClarenceThomas’s wife, to lead the effort.
4 days later, the plane flew to an airport outside Denver, where #Thomas appeared at a ceremony honoring his fmr clerk, federal Judge Allison Eid. The next day, it flew back to northern VA where Thomas lives.
Thomas’ financial disclosure for that year contains 2 speaking engagements: one in NYC & another at a #FederalistSociety conference in TX. His trip to the #Koch event in CA is not on the form.
#Thomas’ appearances were arranged w/the help of #LeonardLeo, the #FederalistSociety leader, acc/to the fmr snr #Koch network employee. “Leonard was the conduit who would get him,” the former employee said. During one summit, Thomas gave a talk w/Leo in an interview format, the #donor recalled.

But the movement that has had such a profound impact on the courts today — one that involves #money & #politics, more than legal theories or principles — gained steam in the wake of the #CitizensUnited decision.
The activists included #FederalistSociety leader #LeonardLeo &his ideological soulmate, a hard-edged activist named #GinniThomas, the wife of #SCOTUS Justice #ClarenceThomas.

Sitting tucked into a couch, with wire-rimmed glasses and hair gone to gray, Leo conveyed his inspiration and intentions: “I just said to myself, ‘Well, if this can work for law, why can’t it work for lots of other areas of American culture and American life where things are really messed up right now?’”
Teneo is building what Leo called in the video “networks of conservatives that can roll back” liberal influence in #WallStreet and #SiliconValley, among #authors and #academics, with pro #athletes and #Hollywood producers.

In short, Eastman's hostility to US democracy and to its endorsement of the rights of minority communities including the LGBTQ community, doesn't arise out of nowhere: it has a specific right-wing Catholic origin, an ideological center also shared by the group of Supremes who now control the Supreme Court.

Both Eastman and Leo are, it's reported, members of the powerful, wealthy, secretive, right-wing Catholic cult Opus Dei, which has long been inimical to democracy and has strong theocratic aspirations.
A number of the Supremes who constitute the right-wing Catholic cabal now controlling the court have Opus Dei ties. (The one non-Catholic member of the cabal, Gorsuch, was raised Catholic.)
