This is a fascinating look at a lot of the issues that are still vitally important today (the panel is from the fall, & does seem to correctly call most of the cases that have been decided since then), and I particularly liked the discussion on rights of applying #AI to dead people. When Avianca asked a Manhattan federal judge to toss out the case, Mr. Mata’s lawyers vehemently objected, submitting a 10-page brief that cited more than half a dozen relevant court decisions. There was Martinez v. Delta Air Lines, Zicherman v. Korean Air Lines and, of course, Varghese v. China Southern Airlines, with its learned discussion of federal law and “the tolling effect of the automatic stay on a statute of limitations.”
There was just one hitch: No one — not the airline’s lawyers, not even the judge himself — could find the decisions or the quotations cited and summarized in the brief.

A lawyer tried to cover up their lack of expertise in federal law by using ChatGPT to cover for them. And like anyone who has actually used ChatGPT before could have predicted, it produced plausible-sounding bullshit. Also note that the case did have a lawyer of record, who is supposed to be qualified in federal law. Had they actually done their job, none of this would have made into court.

I followed this story elsewhere. If I had it right, the underlying #lawyer not only used a false case citation, but when caught, used #ChatGPT to write a fake case opinion to provide the #court. ChatGPT is software which can put words together to sound good. Some people call it "Artificial Intelligence" - but it isn't really "intelligent", it's more like your phone guessing your next word.

A lawyer asked it a law question, and ChatGPT outputted some words.

The lawyer seems to have thought the output was based on real law cases. He didn't check if the info was true before he gave it to the court. Now he's in trouble for telling the court things which weren't true.

At the beginning of this session, lawmakers filed 140 anti-LGBTQ+ bills. As of this writing, only 8 of those bills are still viable, which means the other 132 bad bills are dead. Like, dead dead. That’s 94% of the bad bills!! Granted, the 8 remaining bills are Very Bad, but it’s still important to recognize how many of the fights we won.

We couldn’t have fought off that many bills without all of your help and support. Every card dropped, every testimony read, every email sent, every phone call made, and every person who showed up made this possible. Navigating the uncharted waters of this session has been unbelievably challenging and exhausting, and we’re so grateful to all of y’all who’ve kept our beautiful, queer ship afloat. I have to think that Rhodes both thinks that his statements in the hearing will be a call to action for like minded people, and, a false belief that #Trump will be elected in 2024 and then pardon him. My guess is that Trump views Rhodes as a looser for failing to complete the coup and would let Rhodes rot in prison.

And rotting in prison is what Rhodes deserves.

BTW, I really don't think that Trump will be elected in 2024. I doubt that he'll be the GOP candidate. I think Biden will be handily reelected. The country is sick of the extremist GOP policies and the #Florida model.

I am not saying I am a fan of Justice #Kavanaugh, but he makes a very simple point in his recent dissent in an #EPA case - "adjacent" and "adjoining" have different meanings. Black's #Law #Dictionary literally indicates these two words should be compared as supporting different propositions (adjacent cf. adjoining). I really enjoyed this episode of Chris Hayes’ podcast. He talks to a gun industry veteran that saw first-hand how the industry went off the rails in the 90s.

The discussion focuses on the question “What will turn the ship?”. We’re so far down the path of gun proliferation and embedded gun culture that making any progress can seem hopeless.

The guest suggests that a cultural change is both critical and feasible.

We need to make armed intimidation no longer acceptable.

Outlawing “open carry” across the country, with stiff penalties for acts of armed intimidation.

Otherwise, among other ongoing horrors, we’ll continue to see “The Second Amendment eat The First Amendment”

The laws that dictate generational wealth are biased to the States. If you do not have a Life Will and zero heirs, State probate has title to all your stuff when you die. Even if you have heirs, State Probate can refuse to honor the heirs by holding the estate on a tax question for decades. They wait the heirs out, maybe they die. State gets all the estate. Generations of wealth transferred.

* Forcing open all encrypted emails and scanning them is like gov opening all mailed paper letters.

Just finished @stevevladeck ‘s book “The Shadow Docket: How the Supreme Court Uses Stealth Rulings to Amass Power and Undermine the Republic.” Absolutely an outstanding read about a part of the #SCOTUS that has huge implications but few people, including lawyers, see and understand.

It is an informative and accessible read for non-lawyers and lawyers alike. And it is a crucial book for those who want to understand the present Court’s legitimacy crisis and its impact on American #democracy and #IndividualRights. I cannot recommend it enough.
