That was because ChatGPT had invented everything.

The lawyer who created the brief, Steven A. Schwartz of the firm Levidow, Levidow & Oberman, threw himself on the mercy of the court on Thursday, saying in an affidavit that he had used the artificial intelligence program to do his legal research — “a source that has revealed itself to be unreliable.”"

A lawyer tried to cover up their lack of expertise in federal law by using ChatGPT to cover for them. And like anyone who has actually used ChatGPT before could have predicted, it produced plausible-sounding bullshit. Also note that the case did have a lawyer of record, who is supposed to be qualified in federal law. Had they actually done their job, none of this would have made into court.

ChatGPT is software which can put words together to sound good. Some people call it "Artificial Intelligence" - but it isn't really "intelligent", it's more like your phone guessing your next word.

A lawyer asked it a law question, and ChatGPT outputted some words.

The lawyer seems to have thought the output was based on real law cases. He didn't check if the info was true before he gave it to the court. Now he's in trouble for telling the court things which weren't true.

That’s 94% of the bad bills!! Granted, the 8 remaining bills are Very Bad, but it’s still important to recognize how many of the fights we won.

We couldn’t have fought off that many bills without all of your help and support. I have to think that Rhodes both thinks that his statements in the hearing will be a call to action for like minded people, and, a false belief that #Trump will be elected in 2024 and then pardon him. My guess is that Trump views Rhodes as a looser for failing to complete the coup and would let Rhodes rot in prison.

And rotting in prison is what Rhodes deserves.

BTW, I really don't think that Trump will be elected in 2024. I doubt that he'll be the GOP candidate. I think Biden will be handily reelected. The country is sick of the extremist GOP policies and the #Florida model.

The discussion focuses on the question “What will turn the ship?”. We’re so far down the path of gun proliferation and embedded gun culture that making any progress can seem hopeless.

The guest suggests that a cultural change is both critical and feasible.

We need to make armed intimidation no longer acceptable.

Outlawing “open carry” across the country, with stiff penalties for acts of armed intimidation.

The laws that dictate generational wealth are biased to the States. If you do not have a Life Will and zero heirs, State probate has title to all your stuff when you die. Even if you have heirs, State Probate can refuse to honor the heirs by holding the estate on a tax question for decades. They wait the heirs out, maybe they die. State gets all the estate. Generations of wealth transferred.

@couts I know, I know, tech changes everything and we're comparing apples with metal oranges--but tbh, sometimes I think we'd be better off just going ahead and treating new tech as if it were old stuff under existing #law, e.g.:

* Forcing open all encrypted emails and scanning them is like gov opening all mailed paper letters.

* #AI & #LLMs are servants whose incurred liabilities are vicariously attributable to their masters and/or are products subject to strict liability.

I propose the Eat Crow PAC, to be crowdfunded by the left, which awards $1 million honoraria to Chief Justice Roberts, Justice Gorsuch and anyone else who wants to get in on it, for each opinion in which they join the liberal justices to form a majority. $10 million for reversing Citizens United, Rucho or Dobbs. Apparently this would be entirely lawful; the right is already doing it. Who’s in?

In other news, today I got accepted to the International Summer School Banking and Capital Markets Law at Università Cattolica del Sacro Cuore this July.
I'm hoping to present a draft of my paper "Historical and Philosophical Origins of Financial Reporting and Their Impact on Regulation of Non-financial ESG Reporting: A Comparative Study of the US & EU" (I have to wait until the Scientific Committee decides the final lineup to know if I'm presenting but the paper, but it'll be done anyway)

Just finished @stevevladeck ‘s book “The Shadow Docket: How the Supreme Court Uses Stealth Rulings to Amass Power and Undermine the Republic.” Absolutely an outstanding read about a part of the #SCOTUS that has huge implications but few people, including lawyers, see and understand.

It is an informative and accessible read for non-lawyers and lawyers alike. And it is a crucial book for those who want to understand the present Court’s legitimacy crisis and its impact on American #democracy and #IndividualRights. I cannot recommend it enough.
