"Opponents of the #Line3 oil pipeline are celebrating an Aitkin County judge’s decision to dismiss charges against three Native women related to a 2021 protest.
"Activists #WinonaLaDuke, #TaniaAubid and #DawnGoodwin helped lead rallies as #Enbridge began work on a new #OilPipeline across northern Minnesota more than two years ago.
"The charges against them stemmed from a rally on Jan. 9, 2021, when a large group gathered at a pipeline construction site near the #MississippiRiver in Aitkin County.
"The opponents, who called themselves #WaterProtectors carried signs and walked down a county road. Some Native women danced in jingle dresses, a healing tradition.
"Some group members later moved to another Aitkin County location, where they walked along U.S. Highway 169 and refused to leave a Line 3 construction site.
"LaDuke, Goodwin and Aubid were not arrested on Jan. 9. Authorities charged them weeks later by summons after identifying them in social media posts. They faced gross misdemeanor charges of trespassing and harassment, as well as misdemeanor unlawful assembly and public nuisance.
"A jury trial was scheduled to begin this week. But in a forceful opinion filed Sept. 14, District Court Judge Leslie Metzen dismissed all the charges.
"Metzen’s order noted the government’s historical mistreatment of #Indigenous people.
"'In the last 20 years I have come to a broader understanding of what we, the now dominant culture, did to try to eradicate our indigenous neighbors,' she wrote. 'We moved them by force and power and violence off the land where they lived for thousands of years. To make peace, we signed treaties with them that promised many things they never received.'
"Metzen wrote that she finds it 'within the furtherance of justice' to protect the defendants who were peacefully protesting to protect the land addressed in those treaties.
"She wrote that as respected members of #Anishinaabe tribes, LaDuke, Aubid and Goodwin were exercising their #FreeSpeech rights and #spiritual beliefs, including 'their heartfelt belief that the waters of Minnesota need to be protected from damage that could result from the #pipeline.'
'To criminalize their behavior would be the crime,' she added."

For #opensource Sunday, I looked into adding unit testing for one of my #python #blender add-ons. I used blender-addon-tester for #nviewaddon, but it's frankly a hassle to setup and has had few updates lately.
But I found this amazing lightweight script. Running a test or fixture inside Blender is determined by a simple decorator. And that also means it can run natively in your IDE (#pycharm is my preferred).

One of my #PowerShell hacks for #PowerBI just got a huge #upgrade: #Pipeline support!
In layman's terms, this means that one #function can be strung together with another function in a single PowerShell command, and the outputs from the first function feed directly into the second's inputs. The best part is that the whole chain of functions can operate as a #stream, so as soon as the first item is available, it gets passed down to the next function in the chain, which begins processing that item, while the previous function is working on the next item in the queue. It's like an #AssemblyLine for data!
Of course, now I'll have to go back and apply this technique to all of the other functions I've written previously. #NoRestForTheWicked 😈

The company also reported spending $60,000 lobbying the House and Senate on “issues related to infrastructure permitting,” among other topics.
While the push for “permitting reform” stalled, the deal reached by the Joe Biden administration and congressional Republicans in May to raise the federal debt limit included a provision expediting the controversial #Mountain #Valley #Pipeline — which opponents say will cause emissions equivalent to twenty-six new coal-fired power plants — and shielding the project from further legal challenges.
#Valero reported #lobbying on permitting issues in the debt ceiling deal, as did Texas-based #Energy #Transfer #Partners, whose billionaire chairman Kelcy Warren gave $5,000 to the Congressional Leadership Fund in March. Energy Transfer also donated $2 million to the fund last year.
While neither Valero nor Energy Transfer are among the consortium of companies involved with the Mountain Valley Pipeline, both companies have faced their own recent permitting woes.
In 2021, legal challenges and intense public opposition halted a planned pipeline that would have transported crude oil from Valero’s Memphis, Teneessee, refinery to Mississippi for export — but local activists fear the company is looking for a way to revive the project.
And Energy Transfer, the company behind the fiercely contested Dakota Access Pipeline, is currently at odds with the Biden administration over the denial of a permit for a planned liquefied natural gas export terminal in Louisiana.

"A wildfire that started in #Klickitat County, Washington, on Friday afternoon destroyed more than 30,000 acres in less than a day and continues to grow as it feeds on brush, grass and forest vegetation.
"Fire crews are working to extinguish the #NewellRoadWildfire near #Bickleton, which has resulted in the evacuation of residents in the rural area, and is threatening #farms, #livestock, #homes and #wind and #SolarFarms, reported KOMO News.
"'It's very difficult terrain to fight fire,' said Allen Lebovitz, a spokesperson for the state's Department of Natural Resources, as Reuters reported. 'We are under a red flag warning. That's a #firefighter's worst nightmare because the #humidity is dropping precipitously. The winds are picking up. And so the fire carries extremely fast.'
"The wildfire is burning just to the north of where the #Oregon-Washington border is represented by the #ColumbiaRiver. It has destroyed several structures and is threatening a #NaturalGas #pipeline.
"Lebovitz said the fire was heading in the direction of the #Yakama Indian Reservation."
The… #WildernessSociety & other #environmental grps…had urged the court to uphold the temporary halt in #pipeline completion… & cited an 1871 #SCOTUS #precedent that held that #Congress can specify rules about how #FederalCourt cases should be heard & resolved, but it cannot #dictate how federal courts should rule, as that would be an #unconstitutional intrusion the #SeparatePowers of the #judiciary & would allow Congress "to pick winners & losers" in #litigation that before the federal courts.
As for any challenge to the #constitutionality of the provision, the bill gave the DC #FederalCourts exclusive power to rule on any #constitutional challenge.
Citing that #law, lawyers for the #pipeline asked the #SupremeCourt to vacate the lower court order & direct dismissal of the litigation. They argued that under the new law, the 4th Circuit Court of Appeals no longer has the power to hear the case. The federal gov weighed in as well, supporting the pipeline's #legal position.
This time, however, #pipeline advocates had a new federal #law on their side — & in an unusual place. Tucked into last month's deal to raise the #DebtCeiling & avoid default was a provision Sen #JoeManchin insisted on in exchange for his support. In explicit terms, #Congress not only approved the #MountainValleyPipeline, but "#Section234" of the debt ceiling bill also took away the ability of #FederalCourts to hear any remaining challenges to it (um, what?).

The pipeline is controversial, & over the past 6 yrs, various lower federal court decisions have interrupted & delayed its construction. In the current round of #litigation, the 4th Circuit Court of Appeals issued an order that temporarily blocked completion of the #pipeline while the court reviewed #ForestService & #BureauOfLandManagement authorizations for the pipeline's completion.

"A federal judge has given the city of Charleston an early win in its climate change lawsuit against '#BigOil' by ruling the case will stay in #SouthCarolina, where the city wants the issue fought.
"U.S. District Judge Richard Gergel agreed on July 5 that Charleston’s bid seeking to make #FossilFuel companies pay for #climate damages could proceed in state court, where it was initially filed.
"City officials welcomed the decision, which some legal experts say creates a more favorable stage in arguing that the multiple #oil and #gas companies which have operated in the U.S. for decades knew of the #environmentally #hazardous affects of their products.
"'We agree wholeheartedly with him,' said Chloe Field, a city spokeswoman. 'It is time to move towards trial in the Court of Common Pleas where we filed this case nearly three years ago.'
"In 2020, the city of Charleston filed the lawsuit against two dozen major #oil and #pipeline companies, alleging their products and the spread of misinformation about #FossilFuels have caused #ClimateChange leading to repetitive and disastrous #flooding in the city.
