I've always had problems with speech. When I'm hypomanic, composing sentences in real time is problematic. The words I need don't spring to mind, even if I can visualise the idea I want to convey.
My memory might not work properly. I usually can't remember the names of people, places, movies, etc.
Hypomanic jerky coordination can causes thought patterns and speech to be jerky.
I've just stopped doing speeches at any type of gathering.

I'm too gloomy to come up with a clever quip about the Supreme Court opinions today at 10 am.
As a First Amdt prof I am particularly awaiting rulings on 303 Creative (the free speech right to disc against LGBTQ couples) & Groff (Title VII requirement to accommodate religion unless undue hardship)
and of course, we will soon (today? tomorrow?) have decisions on student loans and affirmative action

On the other, too high a standard of subjective intent for a true threat unprotected by the Free Speech Clause would allow speakers to terrify their targets and claim lack of sufficent proof that they intended or knew that speech was threatening.

In #Counterman, #SupremeCourt had to balance the risk of chilling useful speech against the risk of letting people terrify & intimidate others w/o consequences
On the one hand, the lack of a subjective requirement for a true threat might chill speech that was rhetorical or joking or art bc speakers could not be sure what a court would conclude about reasonableness and stay silent

In Counterman, the Free Speech Clause issue is the definition of a true threat
True threats are an unprotected category of speech that lies outside the First Amendment.
That is, a govt may ban true threats (e.g. in a stalking statute) without violating the free speech clause.
2. Groff v. DeJoy: What counts as an “undue hardship” under Title VII’s requirement that employers accommodate employees religion unless it imposes an undue hardship.

Remember, *all* Dominion could get was a money judgment against Fox. A federal court is not going to order Fox to make a statement as that is hugely problematic from a First Amendment standpoint. Fox already lost on the important issue when the Court ruled that Fox's claims about the 2020 election were false.
Dominion avoided what could have been years or even decades of appeals. That is a huge win for them and a huge admission from Fox.
We need to reconsider the rules of judging incitement in the era of viral media.
Wikipedia says: "The two legal prongs that constitute incitement of imminent lawless action are as follows: Advocacy of force or criminal activity does not receive First Amendment protections if (1) the advocacy is directed to inciting or producing imminent lawless action, and (2) is likely to incite or produce such action."
However, time is twisty on the internet. It splits into pieces experienced differently by different viewers. It loops back and is re-experienced in a way that is intensifying. It holds still while others show up to see it later.
The standard cannot reasonably be whether action imminently follows the saying, but rather the viewing or the re-viewing, or else the action is both more potent as it becomes more invisible to law, most viewings being ultimately not in the moment but later.
Detractors will point to other acts of positive effect that likewise operate in this way. But such what-about-ism does not undo the truth of what I've said. There are two prongs of the incitement charge. The "imminent" standard is more complex in the modern world. But likely to yield bad action still matters.
Democrats and ESPECIALLY Democrat leaders do not stand up with bats or guns while making allegedly metaphorical or joking hints that violence is good or to be rewarded or forgiven. Democrats do not organize field trips of their fellows to comfort those who have taken up arms against democratic process, nor do they hint of medals or pardons.
But GOP leaders do. GOP egging on off violence lingers and gets replayed and distilled in ways they must be held accountable for.
We must not be made timid by claims that aggressive prosecution is unprecedented. It is the threat that is unprecedented. As with Climate Change, we must be clear that proportional responses to unprecedented challenges are not radical but simply necessary. Inaction in the face of unprecedented threat is radical.
In this case, social media presents new threats to democratic society by making incitement more potent. We must not let this increased potency, through its complex delivery mechanisms, become a defense against the crime itself. It is not radical but common sense to see the effect it is having. If we do not prosecute ever-more-routine incitements by GOP leaders, it will be their roadmap to dismantling democracy and civilized society.
