Republicans’ abortion bans are nothing like those in Europe

Moreover, European countries that have 12-week limits on “elective” abortions still make it fairly easy for women to get abortions later on, with relatively broad exceptions for mental health or socioeconomic circumstances. Republicans have aggressively fought against similar exceptions, even the risk of suicide if a pregnancy continues — as a factor.

As I talked about here, not long ago, men were free to grab women–as long as they grabbed women lower than them on the hierarchy. The idea that wealthy men and powerful men should have free access to women whom society considered beneath them on the social hierarchy dates far back in human history. Abortion is often not an easy decision and sometimes required to save the life of a pregnant person. Regardless of the circumstances, it's their body so it should be their choice.

Some religious nutjobs believe that an unborn bundle of cells has more rights than a living adult human.

It's morally repugnant for religious people who run hospitals to think they can pick-and-choose what type of treatment to offer patients who go to them for medical help.

Ugh. This “reversal” nonsense is actually being advocated by a “Pregnancy Care Center” in Seguin, Texas. And they’re supported by United Way.

The Supreme Court has held that states generally cannot bar or place serious burdens on the public’s access to contraceptives. The right was established pursuant to a legal doctrine called substantive due process. In one case, a clinician refused to remove an intrauterine device (IUD) for a patient who was between 10 and 12 weeks pregnant, despite the fact that the IUD had partially expelled, increasing the patient’s risk of infection or miscarriage.

“The doctor did not feel comfortable removing the IUD because it could cause a miscarriage,” wrote one physician consulted on the case. “The context provided was concern over the recent changes in law that create [the] possibility for felony charges for providers causing abortion in our state.”

Individual cases of health complications related to abortion bans have emerged since the June ruling, including stories of women turned away from hospitals with life-threatening pregnancy conditions as doctors and hospital administrators fear the legal risk that could come with terminating even a pregnancy that could jeopardize the mother’s well-being. But the new report, which listed 50 examples shared by providers who chose to participate in a national survey, represented an effort to capture a more expansive picture of how health care has been affected by abortion bans.

Two friends were denied care after Florida banned abortion. One almost died.

The abortion argument is about controlling women and their bodies, and it’s as disgusting as it is shameful. This is pure misogyny.

Abortion isn’t the crime here. The crime is the abuse of women mentally, emotionally, and physically. They are being denied control over their own bodies and health decisions. These are personal, private matters; they deserve the utmost respect.

Biden Administration Moves to Ban Healthcare Workers From Reporting Abortions to Police

So it looks like there’s some confusion around what this exactly is, so let me try to add some context:

As part of all these other moves that law enforcement in anti-choice states are taking (including literal fucking checkpoints at the New Mexico-Texas border), those antitrust law enforcement are also looking to send subpoenas for medical records to abortion clinics in pro-choice states in order to prosecute the women (if that state prosecutes the women) or the people that helped her get the abortion. The medical professionals in the states, of course, feel like they are stuck between a rock and a hard place. They don’t want to betray the patient confidentiality, but at the same time they don’t want to be held in contempt themselves for failure to comply with a subpoena.

The federal government, except in particular circumstances, can’t intervene in a state court’s prosecution of its own state criminal laws, but it can involve itself when that criminal process crosses state lines. So what this proposed rule is doing is prohibiting law-enforcement from subpoenaing records related to reproductive health services outside of their own state. And basically telling healthcare providers in pro-choice states that if they don’t respond to a subpoena, they are not breaking the law; rather, they only break the law if they do handover the records as that will be a violation of HIPAA if the patient did not consent.

As an aside, this rule did not come out of nowhere. If you didn’t know this already, if you are in a part of a Part 2 substance-abuse program, those records also have very strict rules about when they can be shared with law-enforcement. A while back, there was concern that people would not seek treatment for their substance abuse out of fear they would get arrested and lose their job. So the federal government modified HIPAA to prevent law-enforcement and employers from being able to get records about substance-abuse treatment in a federally funded program without explicit patient consent.
